General conditions of sale of the
“BEAUNE & PAYS BEAUNOIS” Tourist Office Cat.I
Article 1
Tourist Offices registered, under the law of 22 July 2009, can perform the reservation and sale of all types of services, leisure and reception of general interest in their area of operation. They facilitate public interaction by offering them a choice of services.
Tourist Offices are local tourism organisations, made available to service providers which have concluded a mandate agreement with them.
Tourist Offices cannot be held liable in the event of use of these contracts by third parties or for purposes other than tourism.
Article 2 - Duration of the service
The customer mentioned on the voucher (or ticket) indicating a service of a fixed duration cannot, under any circumstances, avail themselves of any right to remain within the premises at the end of the service.
Article 3 - Liability
The "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat. I, which offers services to a customer, is the sole contact for said customer and is responsible to them for the performance of the obligations arising from these terms and conditions of sale. The "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat. I cannot be held responsible for fortuitous events, cases of force majeure or any person outside the organisation and conduct of the service.
Article 4 - Reservation
A reservation becomes final when the full price has been paid to the "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat. I before the date and time limit on the voucher (or ticket).
Article 5 - Voucher
Upon collection of the costs of the service, the "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat. I gives the customer two copies of the voucher (or ticket), a copy of which must be given by the customer to the service provider upon arrival.
Article 6 - Arrival
The customer must arrive on the specified day at the times mentioned on the voucher (or ticket).
Should this prove impossible, the customer undertakes to notify the "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat. I.
In the event of late arrival or last-minute problems, the customer must notify the service provider whose address and telephone number or email address appear on the purchase ticket.
Article 7 - Cancellation by the customer
Any cancellation must be reported to the reception service of the "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat. I on + 33 (0)3 80 262 130 or by email billetterie(at)beaune-tourisme.fr, specifying the order number. The customer must obtain a cancellation number confirming registration of cancellation.
If cancellation takes place less than 24 hours before the service date, 100% of the order amount will be retained.
In case of no-show by the customer, 100% of the order amount will be retained.
Article 8 - Modification by the service provider or the "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat. I of a substantial element of the service
When, before the scheduled start date of the service, the "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat. I is obliged to make a modification to one of the essential elements of the service, the purchaser may:
- either cancel the reservation and obtain, without penalty, the deferred refund of the sums paid;
- or accept the modification or substitution of the place of service offered by the retailer.
Any price reduction is deducted from any sums remaining due by the purchaser and, if the payment already made by the latter exceeds the price of the modified service, the overpayment will be returned to the customer before the start of the service.
Article 9 – Unexpected problem for the vendor in providing, during the service, the services provided for in the contract
When during the service, the vendor is unable to provide a major part of the services provided for in the contract, representing a significant percentage of the price paid by the purchaser, the "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat. I, without prejudice to claims for compensation for any damage suffered, will offer a service to replace the planned service, bearing where required any additional cost. If the service accepted by the purchaser is of inferior quality, the "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat. I will refund the price difference before the end of the service. If the vendor cannot offer a replacement service, or if it is refused by the purchaser for valid reasons, the former will pay the latter compensation calculated on the same basis as in case of cancellation by the vendor.
Article 10 - Cancellation by the vendor
When, before the start of the service, the "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat. I cancels the service because of the service provider, it must inform the purchaser before or at the time the service begins. The purchaser will be reimbursed, as far as possible, immediately or subsequently with the sums paid - without any compensation.
Article 11 - Interruption of the service
In the event of interruption of the service by the customer, no refund will be made.
Article 12 – Capacity
This voucher (or ticket) is issued for a specific number of people. If the number of participants exceeds the capacity provided by the service, the provider may refuse additional customers.
Article 13 - Transfer of the voucher by the customer
The purchaser may transfer their voucher to an assignee who meets the same conditions as they do to perform the service. In this case, the purchaser is required to inform the "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat. I before the start of the service.
The transfer of the voucher (ticket) must be made at cost price.
The assignor and transferee are jointly and severally liable vis-à-vis the vendor for the payment of the balance, price and any additional costs incurred by this transfer.
Article 14 - Insurance
The customer is liable for all damages arising on their part. They are invited to take out a tourist-type insurance contract for these various risks.
Article 15 - Special conditions of service
The special conditions of the services sold on by the "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat. I are communicated with the voucher (or ticket).
An insufficient number of participants may be a valid reason for cancelling certain types of services.
In this case, the "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat. I reimburses all sums paid, as far as possible, immediately or subsequently.
Article 16 - Disputes
Any claim relating to a service must be submitted to the "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat. I within 3 days from the start of the service.
Any other complaint relating to a service must be sent, as soon as possible, by letter, to "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat. I, which alone is competent to issue a decision on disputes.
Any dispute relating to the exclusive application of these general terms and conditions will fall under the exclusive jurisdiction of the courts of the head office of "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat. I or the chief town of its department.
Article 17 - Professional civil liability
The "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat. I has taken out professional liability insurance for local non-profit tourism organisations (Article 60 of Decree No. 94-490 of 15 June 1994) No. 082509/J with the company:

Article 18 - Registration
"BEAUNE & PAYS BEAUNOIS" Tourist Office Cat. I is registered in the ATOUT France register of travel and trip operators under the number IM021100008.
Article 19 - Confidentiality and protection of personal data
In accordance with the "Data Protection Act" law of 6 January 1978, the customer has a right of access, rectification and opposition to their personal data, by contacting the "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat. I at billetterie(at)beaune-tourisme.fr, specifying "Personal Data" as the subject of the email.
